1. Acceptance of Terms
By accessing and using Vetera ("we," "our," or "us"), including our AI-powered veterinary assistant platform, website, mobile applications, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Description of Service
Vetera provides an AI-powered veterinary assistant platform that offers intelligent pre-screening, insights, and AI tools to help veterinarians spend less time looking through records and more time treating patients. Our Service includes but is not limited to:
- AI-powered pre-screening and assessment tools
- Veterinary record management and analysis
- Appointment scheduling and management
- Communication tools between veterinarians and pet owners
- Data analytics and insights
3. User Accounts and Registration
To access certain features of our Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information
- Keep your account credentials secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
4. Messaging and Communication Services
Our Service may include messaging and communication features, including SMS text messaging, email notifications, and in-app messaging. By using these features, you acknowledge and agree to the following:
4.1 Consent for Messaging
End-users consent to receive messages by initiating contact with us via SMS. A user sends a keyword (e.g., "START") to our phone number to request information or alerts. We immediately respond with a confirmation message explaining what they are signing up for and how to stop messages.
Initial Confirmation Message:
"You're subscribed to Vetera messages. You will receive appointment information and updates. Reply STOP to cancel, HELP for help. Message & data rates may apply. Terms and conditions found at [URL]"
Confirmation After User Engagement:
"You're now subscribed to Vetera alerts. Reply STOP to cancel, HELP for help. Msg&Data rates may apply."
No marketing or recurring messages are sent until the user replies to confirm or otherwise engages with the service. By engaging with our messaging service, you consent to receive:
- Appointment reminders and confirmations
- Service updates and notifications
- Account-related communications
- Emergency notifications related to veterinary care
Important: Consent is not a condition of purchase. You may use our other services without subscribing to SMS messaging.
4.2 TCPA Compliance
Our messaging services comply with the Telephone Consumer Protection Act (TCPA) and other applicable laws. By initiating contact with us via SMS and engaging with our service, you acknowledge that:
- You are the owner or authorized user of the mobile device and phone number used to contact us
- You have the authority to provide consent for messages to be sent to this number
- Message and data rates may apply as determined by your mobile carrier
- You are responsible for any charges incurred from your mobile carrier
- You understand that consent is obtained through your active engagement with our SMS service
4.3 Opt-Out Mechanisms
Users can opt out anytime by replying "STOP," which immediately unsubscribes them and sends a confirmation message. You may also opt out by:
- Replying "STOP" to any SMS message (immediate unsubscribe with confirmation)
- Replying "HELP" for assistance with messaging options
- Clicking the unsubscribe link in any email
- Updating your communication preferences in your account settings
- Contacting us directly at support@veteravet.com
When you opt out via SMS, you will receive a confirmation message acknowledging your unsubscribe request. Opting out of SMS messaging will not affect service-related communications delivered through other channels (email, in-app notifications) necessary for the operation of your account and veterinary care coordination.
5. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the collection and use of information as described in our Privacy Policy.
For veterinary professionals, you acknowledge that you are responsible for complying with applicable healthcare privacy laws, including HIPAA, when using our Service to handle patient information.
6. Acceptable Use Policy
You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Transmit harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Use the Service to provide veterinary advice without proper licensing
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Vetera and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the Service without our express written consent.
8. Disclaimers and Limitations
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. VETERA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
VETERA IS NOT A VETERINARY PRACTICE AND DOES NOT PROVIDE VETERINARY MEDICAL ADVICE. OUR SERVICE IS INTENDED TO ASSIST VETERINARY PROFESSIONALS AND SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL VETERINARY CARE.
9. Limitation of Liability
IN NO EVENT SHALL VETERA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
10. Indemnification
You agree to defend, indemnify, and hold harmless Vetera and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Vetera operates, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
